Your decision to purchase from the EncapSulite International, Inc. online website is governed by the policies, terms, and conditions set forth below.  By placing an order, you acknowledge you have read and agreed to our Terms of Sale.  Please note:  EncapSulite International reserves the right to change the terms and conditions at any time without notice. 

 PRIVACY OF INFORMATION

We value your privacy and assure you that any information provided to EncapSulite when purchasing on the EncapSulite website is completely safe.   All transactions are processed through a secure server.   Any buyer information obtained by EncapSulite is kept completely private and used strictly for EncapSulite purposes.  E-Mail and buyer addresses obtained will never be sold or given to a third party. 

LIMITATION OF LIABILITY

EncapSulite International Inc. shall not be liable for any consequential, exemplary or incidental damages to include loss or anticipated revenues or profits relating to or arising from any claim to these Terms of Sale, this website, or the catalog and its products whether a claim is based on warranty or not.   

1.       PRODUCTS

EncapSulite International products and fixtures are unique and custom produced by order.  EncapSulite may discontinue any product at any time without notice.  Substitution product may or may not be available and is the sole discretion of EncapSulite.  All replacement parts for the EncapSulite WaterGuard family listed for sell separately are intended for use with EncapSulite WaterGuard fixtures only.  All other uses are the discretion of the buyer and of no liability to EncapSulite.  Any substitution of replacement parts and products by EncapSulite are guaranteed for the EncapSulite product family the part belongs with. 

2.        ORDERS

Orders are not considered binding until an EncapSulite International representative verifies and corrects or accepts an order.  The order is binding when the buyer has accepted any corrections and a sales order confirmation number has been issued and sent to the buyer.  EncapSulite reserves the right, without prior notification, to limit or refuse service to any buyer. 

3.       EQUAL BRAND SUBSTITUTIONS

Subject to Safety Coated Lamps ONLY:    The EncapSulite fluorescent safety coated lamps offered are Sylvania, Philips, and GE brands. In the untimely invent that a safety coated fluorescent lamp requested is not in stock, EncapSulite will offer the equivalent cross (when applicable) in one of the other two brands.  The price may or may not be the same as the original requested and EncapSulite will promptly inform the buyer and request acceptance of the substitution and price correction if applicable.  No substitution will be shipped without prior written acceptance of the substitution and price corrections.

4.       DELIVERY

Most EncapSulite products and fixtures are unique and custom-made per order and are considered non-stock.  Allow 3 to 5 business days to assemble and ship from the date of receiving an order confirmation number.  Allow 5 business days for FEDEX and UPS ground.  Upgraded shipping services (Next Day or 2 Day Saver) are available at an additional charge.  Depending on the size and weight of your shipment, EncapSulite may request shipping on pallets by freight truck lines.  The EncapSulite goal is to ship your order the safest and most cost efficient.  EncapSulite is not responsible or liable for delays in receiving or completing your order that is caused by an event beyond EncapSulite’s control.  Such events may include, but are not limited to, weather conditions, fire, flood, carrier accidents or losses and carrier strikes. Although not responsible or liable for delays out of our control, EncapSulite will make extra efforts to rectify the delay and get the product to the final destination. 

5.       INTERNATIONAL SHIPMENTS

EncapSulite International does not ship internationally from our website.  Inquiries and quote request will be forwarded to Authorized Distributors who are in countries related to the requestor/buyer or to Authorized USA Distributors who only sell to countries outside the USA.  The Authorized Distributors will be responsible for all shipping arrangements and payments with the requestor/buyer.  EncapSulite assumes no responsibility or correspondence directly from the buyer.  All correspondence will only be between the Authorized dealer and the buyer. 

6.       SHIPPING AND  HANDLING CHARGES

Shipping charges apply to all orders.  Additional handling charges apply to upgraded shipping services, International shipping, and expedited shipments.  These charges are non-refundable in occurrences where EncapSulite has made no error in merchandizing or shipping including authorized returns. 

7.       WARRANTIES

Each EncapSulite product sold on the EncapSulite website is unique and custom-made per order.  Both the EncapSulite safety coated fluorescent lamps warranties and the EncapSulite WaterGuard fixture warranty are available for download under the Resources Tab.

Graphic Art Sleeves, Medical XRAY Sleeves, UV Window filters and panels arecustom-made and non-returnable in all most all circumstances and do not have warranties for replacements.  These products must be ordered accurately by the buyer the first time.  If the buyer is unsure of the correct UV blocking sleeve needed, call customer service at 877-227-8756 for technical help.  We will make every effort to understand your application and help or direct you in your selection for you application or your customer’s application. 

8.       RETURN AND RESTOCKING POLICY

EncapSulite International Inc. stands behind its products and will issue a refund, replacement or credit with an ISSUED RMA providing we are notified within 10 days of receipt of product if the buyer is not satisfied.  A restocking charge of 20% (shipping charges not refunded) will apply to all items returned where EncapSulite has made no error in merchandizing or shipping.  Refunds will be made by original method of payment after inspection of returns.  ALL RETURNS MUST ARRIVE IN THE ORIGINAL PACKAGING AND ALL FREIGHT CHARGES FOR THE RETURN OF PRODUCT ARE TO BE PAID BY THE CUSTOMER.  ANY NON-AUTHORIZED RETURN RECEIVED IN THE ORIGINAL PACKAGING AND IN RESALEBLE CONDITION WILL BE AUTOMATICALLY PROCESSED WITH A 50% RESTOCKING FEE.

9.       DAMAGED OR MISSING SHIPMENTS

EncapSulite will, at our discretion, replace or refund any product damaged or missing during shipping.  Obvious damage or shortages must be noted on the waybills when signed for.  In the case of receiving damaged or shortage of product, please contact 1-877-227-8756 to obtain an RMA.  All claims by the buyer for damage or shortage must be made within 5 days of receipt of product to receive full credit.   

10.    PRICING AND SALES TAX

All listed product pricing on the EncapSulite website are considered correct.  If a product price error is discovered during your order, EncapSulite will honor the incorrect price for that order only with no added quantities to the original request.  The website pricing will be corrected promptly and future orders will be bound to the corrected price.  All pricing on the EncapSulite website does not include shipping, special handling or sales taxes (if applicable).  As the buyer, you are responsible for the payment of any state and local sales or use taxes that may apply to your order.  The sales tax is calculated based on the full invoice price, and may include charges for shipping and handling, if required by law.  By law, EncapSulite International must collect sales tax on orders shipped to Texas locations unless a Texas Resale Exempt form is presented before shipping.
